Despite this, there are many myths and misconceptions surrounding OWI/DUI. In this blog post, we will debunk some of the most common OWI/DUI myths. Myth #1: You can only be arrested for OWI/DUI if your BAC is 0.08% or higher. This is not true. In Wisconsin, you can be arrested for OWI/DUI if your BAC is 0.08% or higher, or if you are under the influence of alcohol or drugs to the extent that you are less safe to drive. This means that you can be arrested for OWI/DUI even if your BAC is below the legal limit. Myth #2: You can beat an OWI/DUI charge if you say you were only having a few drinks. This is not true. The number of drinks you have does not matter. In fact, if you say you had just one or two drinks, what the police hear is I ve been drinking. If a police officer asks you how much you ve had to drink or whether you ve been drinking, you sho

If the phlebotomist cleanses your arm and fails to wait the appropriate length of time, called the dry time, before inserting the needle, the sample may be compromised. Why would a phlebotomist make such a mistake? Let s start by differentiating between the antiseptic wipes used in medical and legal blood draws. Medical Vs. Legal Blood Draws Medical blood draws are different from legal blood draws. In medical blood draws, the antiseptic wipes used to cleanse the arm before inserting the needle are typically ethanol swabs. Ethanol swabs dry in 30 seconds and are excellent antiseptics. In a legal blood test kit, however, the antiseptic wipes are usually Povidone-Iodine or Betadine, which are water-based chemicals. This is because ethanol -- the chemical present in alcohol -- would compromise the sample and render any BAC (Blood Alcohol Concen

If law enforcement catches you driving drunk, one of the immediate and notable repercussions is the potential loss of your driver s license.
When you re stopped under suspicion of Operating While Intoxicated (OWI), you will likely be asked to take a chemical test. If the results of this test are 0.08 blood alcohol concentration (BAC) or greater, you might be given a Notice of Intent to Suspend Operating Privilege (Form MV 3519).
If your license is at risk of suspension, you may have the opportunity to oppose the measure, but you must act quickly. A skilled DUI/OWI defense attorney can help.
What Is a Notice of Intent to Suspend?
A Notice of Intent to Suspend Operating Privilege is a formal document notifying you that your license will be suspended in 30 days. This suspension can last no more than six months.

What To DO When Pulled Over:
When you are pulled over by the police, the best thing you can do is to remain as calm as you can. Here are some tips on what to do when pulled over to ensure that the traffic stop goes as smoothly as possible:
When you see flashing lights in your rearview mirror, pull over to a safe location as soon as possible.
Once you have stopped, turn off your vehicle s ignition.
Keep your hands visible to the officer at all times. The best way to ensure that the officer can see your hands is by putting your hands on the steering wheel.
If you have passengers in the car, remind them to stay calm.
When the officer approaches, speak calmly and respectfully to the police officer.

In addition to driver s license revocation, fines, ignition interlock, and even jail time, you may still face negative social consequences. Finding secure employment after an OWI conviction can be a hurdle due to the background checks requested by most employers.
In Wisconsin, only certain circumstances allow employers to ask prospective employees about past convictions. Even so, in our experience, whether or not it is lawful, some employers will not hire or retain employees with OWI/DUI cases.
An OWI Conviction Could Get You Fired
Wisconsin law protects employees from discrimination based on arrest or conviction records in most circumstances, but not all. For example, if the circumstances of your conviction are substantially related to your job duties, your employer could terminate you or choose not to hire you on those grounds.

However, a failed sobriety test, breath test, or even a blood test does not necessarily mean you were impaired or over the limit. All of these tests may give false results. No sobriety test is foolproof, and a skilled defense attorney will thoroughly investigate how these tests were administered to determine their validity.

Several field sobriety tests are used in Wisconsin and all over the United States. These come from a federally promoted program called Standardized Field Sobriety Testing,or SFST. The old paradigm that we argue cases in court is misleading. We really tell stories in court. The adversarial system is a storytelling contest. Facts, science, and logic inform our stories. They are necessary to our stories, but the story is the thing. Yet, we should ask, What is a story?
A story is a narrative that resonates with the listener because of common experience, even common DNA. A story may move a listener to change, but that change will only be consistent with the listener s existing mindset.
A story has scenes. Scenes are narratives that occur at a specific time in a specific place. Thus, a scene invokes the physical senses. A lawyer should try to present key parts of the case in scenes, as a filmmaker presents a movie. Do it with vivid descriptive language, invoking the senses.
Don t just say, for example, On September 1, the defendant wrongfully fired the plaintiff.

Your freedom, driver s license, and job may be at stake and that weighs heavily on you as you consider an uncertain future.
It is far worse if someone claims that they were injured.
When an injury claim has been made, the stakes go up dramatically. Increased jail and even prison time can result. Choosing an expert OWI attorney is a critical step toward reducing or dismissing these charges.

0.08% Blood Alcohol Concentration (BAC) or higher is above the legal limit. If you have two prior convictions, or you are on present IID status, your limit would be .02, which can be less than a single drink.

Andrew is grateful for the opportunity to share his expertise with other attorneys around the nation, providing them with his five rules for creating and implementing effective sentencing presentations four aimed at defense counsel and one at the client.
As described in The Champion, he writes that a persuasive sentencing presentation encompasses the client s complete existence, which means it must address the aggravating factors and expose the mitigating factors in the context of an entire human life. How can defense counsel tell a story that puts the crime in context?
As President and Dean of the National College for DUI Defense, Andrew believes it is essential to serve as an example and share his approach and techniques with others to benefit the accused.

Scott was charged with a third offense drunk driving. So he was facing some very harsh penalties, including up to a year in jail. One of the things that we always do is review a client's prior record to see if there is any way to challenge a prior conviction. In Scott's case we saw something unusual. He had a conviction for a 2007 arrest. In that case he hired a lawyer, but after almost two years of representation, the lawyer withdrew at the last minute. The judge did not give Scott time to hire another lawyer. In fact, Scott was compelled to represent himself at a jury trial. A jury trial is a very difficult proceeding for even the best lawyers (ask any experienced jury trial lawyer), so Scott really had no chance. He did not know how to question witnesses or how to make arguments. He was inevitably convicted. To Andrew Mishlove, this just didn't seem fair.
