Wisconsin Criminal Law on Causing Injury or Great Bodily Harm While OWI or DWI

Under Wisconsin drunk-driving laws, driving under the influence of any intoxicant is termed OWI: Operating While Under the Influence. Wisconsin also uses the acronym OMVWI for Operating a Motor Vehicle While Intoxicated. This is frequently called DUI for Driving Under the Influence.

The intoxicating agent can be any alcoholic substance, illegal drugs like cocaine, marijuana, a hallucinogen, even a prescription or over-the-counter drug.

Very serious consequences

If you are found guilty of causing injury while OWI (or even if you refused to take a chemical test), you face harsh penalties.

Restricted controlled substance: OWI penalties apply for a person operating a motor vehicle with any detectable presence of a restricted controlled substance in his or her bloodstream. Violations are treated as OWI, and are subject to the same penalties as OWI.

OWI Causing Injury - First or second OWI-related offense:

  • Up to 1 year in jail
  • Fine of up to $2,000 plus a $365 OWI surcharge
  • Driver license revoked for 1-2 years
  • Vehicle will be equipped with an IID (Ignition Interlock Device)
  • If the offense is committed while operating a commercial motor vehicle, then penalties include a 1-year CDL disqualification

OWI Causing Injury - Two or more prior OWI-related offences, the penalties are escalated:

  • Up to 6 years in jail
  • Fine of up to $10,000 plus a $365 OWI surcharge
  • Driver license revoked for 2-3 years
  • Vehicle will be equipped with an IID (Ignition Interlock Device)
  • If the offence was committed while you were operating a commercial vehicle, you will have a lifetime CDL disqualification for a second offense since July 1, 1987
  • If you have an occupational license, you will have to wait 12 months before you can apply to have your license reinstated (if you have two or more OWI offenses within five years)

Causing Great Bodily Harm by OWI:

  • Up to 12.5 years in jail
  • Fine of up to $25,000 plus a $365 OWI surcharge
  • Driver license revoked for 2 years
  • Vehicle will be equipped with an IID (Ignition Interlock Device)
  • If you have an occupational license, you will have to 120 days before you can apply to have your license reinstated (12 months if you have two or more OWI offenses within five years)
  • If the offence was committed while you were operating a commercial motor vehicle under the influence, you face a lifetime disqualification of your Commercial Drivers License (CDL) (for 2nd offense since July 1, 1987)

These penalties can be doubled when a person under 16 old or a pregnant woman was in the vehicle at the time of the offense.

State of Wisconsin v. Pavittar

This gentleman was found quite drunk seated in the driver's seat of his car. A citizen witness had reported that the car was driving erratically. A police lieutenant stated that he saw Pav driving the car. Police dispatch records, however, indicated that the lieutenant arrived at the scene five minutes after the car was parked.
