Do I Need a Lawyer?

You have been charged with Operating While Intoxicated or OWI.
Do you need a Wisconsin drunk-driving attorney? Yes.
But what if you believe you are guilty?  Yes.
But what if your breath test or blood alcohol tests show you were impaired?  Yes.
But what if this is just your first charge?  Yes.

No one really wants a lawyer, but if you have been charged with OWI (commonly called a  DUI), you need a good Wisconsin OWI lawyer as good as Andrew Mishlove.  There are laws designed to protect you when you are in the justice system, and Attorney Mishlove can help you achieve the best resolution for your case.  What can a lawyer do?

  • Evaluate the strength of the case against you.
  • Determine if the police acted inappropriately or violated your rights in any way while stopping, arresting, testing, or charging you.
  • Limit the damage that an OWI or DUI case can have.

Choosing a Lawyer: You Need an Expert in Wisconsin DUI Laws

When you have a heart problem, you go to a cardiologist. When you are charged with DUI or OWI, you need a qualified attorney who specializes in this area.  There is no shortage of Wisconsin lawyers, but who can help you with your case?  Who can’t?

  • The discount lawyer. A discount store handles a lot of volume, which allows them to offer lower prices.  A discount lawyer maintains extremely low overhead (no secretary, investigators, paralegals, etc.).  The goal for them is to get your case, resolve it as quickly as possible, and move on to the next one.
  • The general practitioner.  A lawyer who specializes in real estate can try your drunk-driving case, but they typically lack the specialized knowledge and skillset needed to defend your case optimally.  Often, a plea bargain is considered a successful result.  An OWI lawyer is knowledgeable in the aspects of the laws that apply to you and your case.  Whether the optimal strategy is a plea bargain or a jury trial, you have the assurance that your case will be fought.
  • Pre-eminent criminal defense attorneys.  Be prepared to pay upwards of $10,000, with substantial fees for trial preparation, trial, and other aspects of your case.  They may also not have much experience with drunk-driving as it is a comparatively minor crime, i.e., not glamorous enough for them to bother with.
  • Public defenders. They are typically skilled, experienced attorneys, but are also most often overworked and cannot give your case the individualized attention a DUI or OWI lawyer can.

Your case deserves individual attention, not a conveyer belt mentality.  The American Bar Association recognizes drunk-driving defense as a separate specialty.  Look for a lawyer who is accredited by the National College for DUI Defense (NCDD) and who has experience defending drunk-driving cases at trial.

State of Wisconsin v. Pavittar

This gentleman was found quite drunk seated in the driver's seat of his car. A citizen witness had reported that the car was driving erratically. A police lieutenant stated that he saw Pav driving the car. Police dispatch records, however, indicated that the lieutenant arrived at the scene five minutes after the car was parked. Other witnesses reported a different driver. Attorney Mishlove tried the case to a jury and Pav was found Not Guilty. We saved him from a long jail sentence and irreparable damage to his family
